Overview
PornWorship.com ("PornWorship," "we," "us," or "our") responds to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act, 17 U.S.C. § 512 ("DMCA").
If you believe that content available on PornWorship.com infringes upon a copyright you own or control, you may submit a written notice to our designated DMCA agent as set forth below.
Submitting a DMCA Takedown Notice
To request removal of allegedly infringing material, you must send a written notification that satisfies the requirements of 17 U.S.C. § 512(c)(3). The notice must be submitted to our designated DMCA agent.
Required Information
A valid DMCA takedown notice must contain each of the following elements pursuant to 17 U.S.C. § 512(c)(3):
- Identification of the copyrighted work claimed to have been infringed; or, if multiple works are covered by a single notification, a representative list of such works.
- Identification of the infringing material and information reasonably sufficient to permit us to locate it, including the exact URL(s) on PornWorship.com where the material resides.
- Contact information of the complaining party, including full name, email address, and mailing address and/or telephone number.
- A statement of good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and, under penalty of perjury, that the complaining party is the copyright owner or is authorized to act on behalf of the copyright owner.
- The physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.
Counter-Notification Procedure
If you believe that material you posted or uploaded was removed or disabled as a result of mistake or misidentification, you may submit a written counter-notification to our designated DMCA agent pursuant to 17 U.S.C. § 512(g)(3).
Your counter-notification must include:
- Your full name, email address, and mailing address.
- Identification of the material that was removed or disabled and the URL or location where the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside the United States, the federal district court for any judicial district in which PornWorship.com may be found.
- Your physical or electronic signature.
Upon receipt of a valid counter-notification, we will forward it to the original complainant as required by 17 U.S.C. § 512(g)(2). The removed material may be restored within 10–14 business days unless the copyright owner files an action seeking a court order against you.
Repeat Infringer Policy
In accordance with 17 U.S.C. § 512(i)(1)(A), PornWorship.com maintains a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are determined to be repeat infringers of the copyrights or other intellectual property rights of others.
Misrepresentation & Abuse
Submitting a DMCA notice or counter-notice that contains materially false information may subject you to civil liability pursuant to 17 U.S.C. § 512(f), including damages, attorney fees, and costs incurred by the alleged infringer as a result of the misrepresentation.
